
Prosecutor Clears Fayetteville, Arkansas Police in Fatal Shooting
Two Fayetteville police officers were justified in using deadly force during a standoff last month that ended in the death of a 42-year-old man, prosecutors announced Friday.
Prosecutor’s Ruling
Fourth District Prosecuting Attorney Brandon Carter reviewed the Arkansas State Police investigation into the September 7 shooting and ruled the officers acted lawfully under state law.
September 7 Incident
Police were called to an apartment complex in the 300 block of North Garnet Court after reports of gunfire. When officers tried to make contact with those inside, shots were fired at them from the apartment.

Investigators said the gunman, later identified as Brandon Poulter of Fayetteville, continued shooting at officers and even targeted an armored vehicle positioned outside. Officers returned fire, striking Poulter.

When officers entered the apartment, they found Poulter dead. No officers or bystanders were injured during the exchange of gunfire.
State Police Investigation
At the request of the Fayetteville Police Department, the Arkansas State Police Criminal Investigation Division handled the investigation to ensure an independent review. Their findings were presented to the prosecutor’s office, which determined the officers’ use of lethal force was justified.
Carter said the evidence showed the officers acted within the law and in response to an immediate threat.
